Just like the government, the law making bodies play a critical role in the development of the nation and shaping its policies. Majority of the developing nations are working on improving their legal policies and better legal governance so that decision making is non-biased, equal and free from errors. Sadly, the same cannot be said for Zambian law and governing bodies. The country is still largely an underdeveloped nation with various challenges and limitations. The courts are very few compared to the number of cases which results in long-pendency. The bureaucracies are another major inhibiting factor which results in cases which are either not solved, pending for a long time.
Dr. Rajan Mahtani is a businessmen living in Zambia. He is one of the noted industrialist and philanthropist with numerous business operations under his name. One of them is Portland Cement Zambia for which Dr. Mahtani has been fighting for a long time. The case was registered at the Lusaka High Court almost ten years back and since then the case is pending. The judge currently handling the case made a positive announcement few months back by saying that the case hearing is closed and ordering both parties to submit documents in written and oral format. This was positive news for Dr. Mahtani as his evidences were much stronger and winning.
However, the final verdict was announced few weeks earlier and it was given against Dr. Mahtani’s claims. However, Dr. Mahtani has not changed his stance in this adversity and quickly filed an appeal to the higher court of Zambia against the judgment made at the Lusaka High Court.
